1. Who we are and what PingCab is
PingCab is operated by Ashwrk Ltd, a company registered in England and Wales (company number 17258873) with its registered office at 14–16 Stanley Street, Holyhead, Anglesey LL65 1HG ("we", "us", "PingCab").
PingCab is a booking platform. We connect people who want a taxi with independent, licensed taxi firms in North Wales. We are not a taxi operator, not a transport provider and not a dispatcher: booking requests made through the app are broadcast to licensed firms, and a firm — acting through its drivers — chooses whether to accept them. We never assign a ride to a firm or driver.
Your contract for the journey itself is with the taxi firm that accepts your booking, which remains responsible for the transport service under its own operator licence. Our contract with you covers the booking platform: taking your request, broadcasting it, processing payment and providing the apps.
2. Definitions
- "Rider" — a person using the PingCab app to book journeys.
- "Firm" or "Operator" — an independently owned taxi business, registered on PingCab, whose vehicles and drivers are licensed by its local licensing authority. PingCab is currently hackney-carriage-only: Firms' vehicles hold hackney carriage vehicle licences (plates).
- "Driver" — a driver holding a current hackney carriage driver's licence from the local licensing authority, engaged by a Firm and using the PingCab Pro app at the Firm's invitation.
- "Fare" — the price of the journey, calculated from the hackney carriage tariff set by the local licensing authority and quoted as a fixed price before booking.
- "Connection fee" (shown in the app as the "booking fee") — our platform fee, paid by the Rider on top of the Fare (section 5).
- "Portal" — the Firm-facing web application at admin.ping-cab.com.
Part A — Riders
3. Your account
- You must be at least 18 to create a rider account and book journeys. Children may travel when accompanied in line with the Firm's own policies.
- Keep your details accurate — the name and phone number on your account are shared with the Firm and Driver fulfilling your booking so they can find you and contact you about the ride.
- You are responsible for activity on your account. Tell us immediately if you believe it has been compromised.
- You can delete your account at any time in the app (Profile → Delete account).
4. Bookings and quotes
- When you request a ride we quote a fixed Fare, calculated from the local licensing authority's hackney carriage tariff for the real driving route between your pickup and destination — including the vehicle type you choose, the number of passengers, and any night, weekend or public-holiday rates in that tariff. The quote, including the connection fee, is shown before you confirm.
- Your request is broadcast to eligible Firms' online drivers. A booking exists only when a Firm accepts — until then there is no ride and no charge. While we search we keep you updated in the app, and you can cancel at any time before acceptance at no cost. If we cannot find you a driver, we tell you and nothing is charged.
- Pre-booked (scheduled) rides are offered to Firms' drivers ahead of the pickup time. Acceptance works the same way: a Firm must accept, and we'll notify you when one does.
- The Firm's name, the driver's name, photo (where provided), vehicle and registration plate are shown to you when a booking is accepted, and you can track the vehicle live.
5. Fares and the connection fee
- The Fare belongs to the Firm. PingCab does not take any commission or percentage of the Fare.
- The Fare is the council-set tariff price for your journey — the same hackney carriage tariff that governs the vehicle's meter. We do not surge-price, and no Firm can charge you more than the quote for the quoted journey.
- Our connection fee is 6% of the Fare, subject to a minimum of £1.00 and a maximum of £2.50 per ride — and never more than 20% of the Fare (for the very shortest journeys this cap reduces the fee below £1.00). It is itemised before you book and on your receipt.
- Waiting time: once your driver has arrived at the pickup, the first 5 minutes of waiting are free. After that, waiting is charged at 25p per started minute, capped at £5.00 per ride, added to the final fare and itemised on your receipt.
- The quoted Fare (plus any waiting charge above) is what you pay for the quoted journey. If you change the journey (a different destination, additional stops) the Firm may adjust the final fare to reflect the actual journey, consistent with the tariff and its licensing rules; any adjustment appears on your receipt.
- Tolls or legitimate extras (e.g. airport pickup charges) that apply to your route are either included in the quote or payable as shown by the Firm's tariff.
- We may change the connection fee structure from time to time. Changes never apply retrospectively and are always shown before you book.
6. Payment
- PingCab is card-only. You add a card (or Apple Pay / Google Pay) in the app before your first booking. Card details are collected and stored by our payment provider, Stripe — we never see or store your full card number.
- Nothing is charged until your ride completes. When it does, your saved card is automatically charged the Fare plus the connection fee, in a single payment. A receipt is available in the app.
- The Fare portion is paid to the Firm (which is the merchant for the transport service); we retain the connection fee.
- Do not pay the driver cash for a PingCab booking, and do not accept a request to do so — it removes your payment protection and breaches the Firm's agreement with us. Tips in cash are entirely your choice and go wholly to the driver.
7. Failed payments
- If a technical problem delays the charge, we retry automatically. This never results in you being charged twice.
- If your card is declined after a completed ride, you still owe the Fare and connection fee. We'll notify you in the app; we may retry the card, ask you to pay with another card, and may suspend new bookings until the balance is settled.
- If you believe any charge is wrong, contact support@ping-cab.com — see section 8 for refunds.
8. Cancellations, no-shows and refunds
- Cancelling before completion costs nothing, because nothing has been charged. Repeated late cancellations or booking abuse may lead to account restrictions (section 22).
- If the Firm or driver cancels (e.g. breakdown), you are told immediately and nothing is charged. Your request can be re-broadcast to other firms.
- If you are not at the pickup point within a reasonable time of the driver arriving, the driver may mark the booking a no-show. Firms may apply a reasonable no-show charge consistent with their tariff, shown on your receipt where applied.
- If you were charged in error — for a ride that didn't happen, or the wrong amount — contact us and we will investigate with the Firm and refund promptly where the charge was wrong. Refunds go back to the original payment method.
- Because transport is provided at a specific time at your request, the statutory 14-day "cooling-off" cancellation right for distance contracts does not apply to the journey itself. This does not affect your other statutory rights, including under the Consumer Rights Act 2015.
9. Your conduct
You agree not to: abuse, threaten or discriminate against drivers, firms or our staff; damage or soil vehicles (Firms may charge reasonable cleaning/repair costs); make fraudulent bookings or chargebacks; attempt to move PingCab bookings off-platform to avoid fees; use the in-app chat for anything unlawful or unrelated to the ride; or interfere with the operation or security of the platform. Smoking, open alcohol and unrestrained animals (other than assistance dogs, which are always carried in accordance with the Equality Act 2010) are subject to the Firm's own vehicle rules.
10. Lost property and complaints
- Lost something? Use the in-app chat for your ride or the Support tab, or email support@ping-cab.com with the ride details. Lost property is held by the Firm under its licensing authority's rules; we will connect you.
- Complaints about a journey (driving standards, vehicle condition, driver conduct) are ultimately a matter for the Firm and, where serious, its licensing authority — but report them to us too: we record complaints against Firms and drivers, act on patterns, and will help you escalate. Complaints about the app or a payment are for us directly.
- We aim to acknowledge complaints within 2 working days and resolve payment issues within 14 days.
Part B — Drivers
11. Joining and documents
- Drivers join PingCab only by invitation from a registered Firm. There is no independent-driver sign-up.
- Before going online you must upload a valid driving licence and your hackney carriage driver's licence (badge), which your Firm reviews and approves. You must keep these current — the app and your Firm's portal flag documents approaching expiry, but holding valid licences remains your and your Firm's legal responsibility, not ours.
- You must only use PingCab Pro with a vehicle your Firm has registered and assigned to you.
12. Using PingCab Pro
- Offers show the fare, pickup and destination before you accept. Accepting an offer is your Firm accepting the booking through you as its agent — treat an acceptance as a commitment to the passenger.
- While you are online, PingCab Pro shares your live position with your Firm (their live map and dispatch) — including when the app is in the background. During a ride it is also shared with your passenger. Going offline stops this.
- Payment for PingCab bookings is automatic — never request cash for the fare, and never ask a passenger to cancel and pay off-platform.
- Use the app lawfully and safely: interact with it only when it is safe and legal to do so, in line with the rules on mobile device use while driving.
13. Your relationship with us
You are engaged by your Firm, not by us. PingCab does not employ drivers, does not set your working hours, does not require you to accept any job and does not pay you — your pay and working arrangements are between you and your Firm. Nothing in these terms creates an employment, worker or agency relationship between you and Ashwrk Ltd.
Part C — Taxi firms
14. Registration and eligibility
- Registration is open to taxi businesses whose vehicles and drivers are licensed by their local licensing authority. PingCab is currently hackney-carriage-only: your vehicles must hold hackney carriage vehicle licences (plates) and your drivers current hackney carriage driver's licences. Private hire will follow later. You must provide accurate details at registration — including your legal name, licensing authority and licence numbers — and keep them current in the Portal.
- We verify firms before activating them and may ask for evidence of licensing at any time. Providing false licensing information is grounds for immediate termination.
- The person registering must be authorised to bind the business. Portal accounts are for your business's authorised managers only.
15. The broadcast model
- Booking requests in your area are broadcast to your online, approved drivers. A driver accepting an offer is your firm accepting the booking, made through the driver as your agent — from that moment the passenger is your booking, fulfilled under your operator licence, and the normal legal duties of an operator apply to you.
- We never auto-assign bookings to your firm. Equally, we give no guarantee of booking volume.
- You are responsible for the transport service: vehicle condition, insurance, driver conduct, complying with your licensing authority's requirements, and honouring accepted bookings.
- Bookings you create yourself in the Portal (for example, customers who phone your office) are your own bookings, taken under your own terms: no connection fee applies, and payment — including cash — is a matter between you and your customer. The rider provisions of these terms apply only to bookings made through the PingCab app.
16. Fares, payouts and card costs
- Riders pay the Fare plus our connection fee by card in the app when the ride completes. You receive 100% of the Fare — we take no commission from it.
- Payouts are made through Stripe Connect to your business bank account. You must complete Stripe's onboarding (identity and bank verification) before fares can be paid out; fares taken before onboarding completes are held and settled to you once it does.
- Card processing costs (approximately 1.5% + 20p per transaction) are shared 50/50 between you and us: your half is deducted from the payout, ours comes out of the connection fee. This split is itemised in your Portal.
- If a rider's card is declined after a completed ride, we tell you and the rider, retry where possible and pursue settlement — but we are not an insurer of rider payments and do not guarantee payment of fares a rider fails to settle.
- Refunds we make for erroneous charges are passed through to the party that received the funds.
17. Subscriptions
- Platform access is charged per licensed vehicle per month, and the tier you choose sets how quickly fares are paid out: Standard £5 (weekly payouts), Plus £8 (daily payouts), Instant £12 (same-day payouts). Vehicle counts track your registered fleet automatically; tier changes and fleet changes are prorated by Stripe.
- Your first three months are free. We confirm the date billing starts when you join and remind you before it begins.
- Subscriptions are billed to your card via Stripe and can be cancelled at any time from the Portal (Billing → Manage subscription); cancellation takes effect at the end of the billing period. If your subscription lapses your drivers stop receiving new booking offers.
18. Your compliance obligations
- You must hold, and keep current, every licence required to operate: your operator licence, your drivers' licences and badges, vehicle plates, MOTs and hire-and-reward insurance. The Portal's compliance tools (document storage, expiry warnings, driver approval) exist to help you — they do not transfer any legal responsibility to us.
- You must approve a driver on PingCab only after genuinely checking their documents, and must suspend drivers whose licences lapse.
- You are responsible for your booking records obligations to your licensing authority. Data in the Portal (bookings, drivers, vehicles) is available to you for this purpose.
19. Your drivers and data
- Your drivers use PingCab Pro under your invitation; you are responsible for them being properly licensed and engaged by you.
- Rider personal data you receive through PingCab (names, pickup points, contact routes) may be used only to fulfil the booking and meet your legal record-keeping duties — never for marketing. For your own business records you act as an independent data controller.
Part D — Everyone
20. Licence to use the apps
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the PingCab apps and Portal for their intended purpose. You may not copy, modify, reverse engineer, scrape, resell or interfere with them, or use them to build a competing service. All intellectual property in the platform and the PingCab brand belongs to Ashwrk Ltd. If you downloaded an app from Apple's App Store or Google Play, the store's own terms also apply, and Apple/Google are not responsible for the app or these terms.
21. Availability
We work to keep PingCab available around the clock but do not guarantee uninterrupted service — outages, maintenance and events outside our control (including failures of networks, mapping, payment or hosting providers) can interrupt it. PingCab currently operates in North Wales only.
22. Suspension and termination
- We may suspend or terminate accounts that breach these terms, put others at risk, misuse payments, provide false information, or where required by law or a licensing authority. Where reasonable we'll warn you first; for serious breaches (safety, fraud, unlicensed operation) we may act immediately.
- You can stop using PingCab and delete your account at any time. Firms can cancel their subscription as in section 17. Sections that by their nature survive termination (payments owed, liability, data, governing law) survive.
23. Our liability
- Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, nothing in these terms affects your statutory rights.
- We provide the booking platform with reasonable skill and care. We are not the carrier: the journey is provided by the Firm, and we are not liable for the acts or omissions of Firms or Drivers, including delays, driving standards, vehicle condition or personal injury during a journey — these are matters between you, the Firm and its insurers (and, where relevant, the licensing authority).
- We are not liable for losses that were not foreseeable when you started using PingCab, for losses not caused by our breach, or (for businesses) for loss of profit, business, goodwill or indirect losses.
- For consumers, our total liability in connection with the platform is limited to the greater of £100 and the connection fees you paid us in the previous 12 months. For Firms, our total liability in any 12-month period is limited to the subscription fees you paid us in that period.
24. Indemnity (businesses only)
Firms will indemnify us against losses, claims and costs arising from operating without required licences or insurance, breaching licensing law, or misusing rider data — except to the extent caused by our own breach.
25. Changes to these terms
We may update these terms as the service, law or our business develops. For significant changes we'll give notice in the app or Portal at least 14 days before they take effect; continuing to use PingCab after that is acceptance. If you don't agree, stop using the platform (Firms may cancel under section 17 without penalty).
26. General
These terms are the entire agreement between us regarding the platform. If any provision is found invalid, the rest remain in force. A failure to enforce a right is not a waiver. You may not transfer your rights under these terms; we may transfer ours to a successor of the business, and your rights will not be reduced by that. Except for Apple and Google as noted in section 20, no third party has rights under the Contracts (Rights of Third Parties) Act 1999.
27. Governing law
These terms are governed by the law of England and Wales. Disputes may be brought in the courts of England and Wales; if you are a consumer you may also rely on any mandatory consumer protections and courts of the UK nation where you live.
